Data Protection

Privacy Policy

Basic information

This Privacy Policy is intended to inform users of this website about the nature, scope and purpose of the collection and use of personal data by the Kuny AG website.

We take your privacy very seriously and treat your personal data confidentially and in accordance with the law. As new technologies and the continued development of this website may lead to changes to this Privacy Policy, we encourage you to review this Privacy Policy periodically.

If you provide us with personal data of other persons (such as family members, work colleagues), please make sure the respective persons are aware of this Data Protection Statement and only provide us with their data if you are allowed to do so and such personal data is correct.

This Privacy Notice is aligned with the Swiss Data Protection Act («DPA»). However, the application of this law depends on each individual case.

SSL encryption

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests you send to us as the site operator. An encrypted connection is indicated by the browser’s address bar changing from ‘http://’ to ‘https://’ and the padlock icon appearing in your browser bar.

If SSL encryption is enabled, the data you submit to us cannot be read by third parties.

Access data

On the basis of our legitimate interests (see Article 6(1)(f) GDPR), Kuny AG collects data on website access and stores it as ‘server log files’ on the website server. The following data is logged:

• Website visits
• Time of website access
• Amount of data sent in bytes
• Source/reference by which you arrived at the page
• Browser used
• Operating system used
• IP address used

Server log files are stored for a maximum of 30 days and then deleted. Data is stored for security reasons, e.g. to clarify cases of misuse. If data must be revoked for reasons of proof, it will not be deleted until the incident has been definitively clarified.

Cookies

This website uses cookies. These are text files that are stored on your computer from the server. They contain information about the browser, IP address, operating system and internet connection. We do not disclose this information to third parties or link it to personal data without the relevant consent.

Cookies fulfil two main tasks. They help us to help you navigate through our content and ensure the correct presentation of the website. They are not used to implant viruses or launch programmes.

Users have the opportunity to access our content without cookies. To do so, the corresponding settings must be changed in the browser accordingly. Please inform yourself about how cookies are disabled via the help function of your browser. However, please be aware that in doing to, this may interfere with some of the features of this site and reduce its ease of use. The following websites http://www.aboutads.info/choices/ (USA) and http://www.youronlinechoices.com/uk/your-ad-choices/ (Europe) allow you to manage online advertising cookies.

Collection and processing of personal data

The website operator collects, uses and transfers your personal data only as is permitted by law or if you consent to the collection of said data.
Personal data is all such information that could be used to identify your person and which can be traced back to you, such as your name, email address and telephone number.

You can also visit this website without providing any personal information. However, to improve our online content we (without personal reference) store your access data on this website. This access data includes, for example, the file you requested or the name of your internet service provider. Due to data anonymization, it is not possible to draw conclusions about your person.

We process personal data only after receiving express permission of the users concerned and in compliance with the applicable data protection regulations.
The processing of personal data is based on our legitimate interest in fulfilling our contractually agreed services and to optimise our online content.

Contact

We process personal data such as first name, last name, trade, IP address, email address, place of residence, post code, telephone, fax and content information from the contact form.
If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored in order to process the request and in case of any follow-up questions. We will not share this information without your consent.

The processing of the data entered into the contact form takes place exclusively on the basis of your consent (Article 6(1)(a) GDPR). You can revoke this consent at any time; an informal message sent to us by email is sufficient. The legality of the data processing operations carried out before such revocation will remain unaffected by the revocation.

For this purpose, our WordPress Plugin Contact Form 7 offers the option to Accept via a checkbox. Without this consent, the contact form cannot be sent.

The information you provide in the contact form will remain with us until you ask us to delete it, revoke your consent to its storage, or the purpose of storing the data has elapsed (for example, after your request has been processed). Mandatory statutory provisions – especially retention periods – remain unaffected.

Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (‘Google’). The provider is Google Inc., 1600 Amphitheatre Parkway Mountain View, CA 94043, USA. Google Analytics uses cookies, text files that are stored on your computer and that allow an analysis of the website’s usage through users such as yourself. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is enabled on this website, Google will truncate your IP address beforehand within Member States of the European Union or other countries that are party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website usage and internet usage to the website operator.

The IP address provided by Google Analytics within the framework of Google Analytics will not be merged with other data provided by Google.

This website uses Google Analytics with the extension ‘_anonymizeIp ()’. As a result, this process shortens IP addresses, making it impossible to trace them back to an individual user. Insofar as the data collected about you is assigned a personal reference, it will be immediately excluded and any personal data will be deleted immediately.

We use Google Analytics to analyse and regularly improve the use of our website. With these statistics, we can improve our content and make it more interesting for you as a user. For the exceptional cases in which personal information is transferred to the US, Google is subject to the EU-US Privacy Shield, find out more at www.privacyshield.gov/EU-US Framework. The legal basis for the use of Google Analytics is given in Article 6(1)(1)(f) GDPR.

This website also uses Google Analytics for cross-device analysis of visitor traffic conducted through a user ID. You can disable the cross-device analysis of your use via your customer account under ‘My Data’ and then ‘Personal Data’.

Opposition to data collection

You can prevent the storage of cookies by altering the corresponding setting of your browser software; however, we point out that in this case you may not be able to use all the functions of this website in full. You may also prevent the collection by Google of the data generated by the cookie and related to your use of the website (including your IP address) as well as the processing of this data by Google by using the browser plug-in available under the following link. Download and install it at: http://tools.google.com/dlpage/gaoptout?hl=de.

You can also prevent the collection of your data by Google Analytics by clicking on the following link. An opt-out cookie will be filed to prevent your data from being collected during future visits to this site: Disable Google Analytics.

Contract data processing

We have entered into an agreement with Google for contract data processing and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Google Analytics’ demographics feature

This website uses the demographics feature of Google Analytics. As a result, reports can be produced that contain information on the age, gender and interests of the site visitors. This data results from interest-based advertising from Google and from third-party visitor data. This data cannot be attributed back to a specific person. You can disable this feature at any time through the ad settings in your Google Account, or generally prohibit the collection of your data by Google Analytics, as described in the ‘Opposition to data collection’ section.

Use of Google remarketing

This website uses the remarketing feature of Google Inc. The feature is designed to present interest-based ads to website visitors within the Google network. A cookie is stored within the browser of the website visitor, which makes it possible to recognise the visitor when he or she visits websites that belong to the Google advertising network. On these pages, visitors may be presented with ads related to content that the visitor previously viewed on web pages using Google’s remarketing feature.

Google claims not to collect any personal information during this process. However, if you do not wish to use Google remarketing, you can opt out by changing the appropriate settings at http://www.google.com/settings/ads. Alternatively, you can disable the use of cookies for interest-based advertising through the Network Advertising Initiative by following the instructions at http://www.networkadvertising.org/managing/opt_out.asp.

Use of Google AdWords

Our website uses Google conversion tracking. If you have reached our website via an advertisement created by Google, Google Adwords will file a cookie on your computer. The conversion tracking cookie is filed when a user clicks on a Google-served ad. These cookies become invalid after 30 days and are not used for personal identification. If the user visits certain pages on our website and the cookie has not expired, we and Google may recognise that the user clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie. Cookies cannot be tracked through the advertisers’ websites. Information gathered using the conversion cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. Customers are told the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive any information that personally identifies these users.

If you don’t want to be involved in this tracking, you can refuse the required filing of a cookie, for example there is a browser setting that generally disables the automatic filing of cookies or you can set your browser to block cookies from the googleleadservices.com domain.
Please note that you should not delete opt-out cookies as long as you do not want measurement data to be recorded. If you delete all your cookies in the browser, you must file the respective opt-out cookie again.

Integration of Google Maps

On this website we use Google Maps. This allows us to show you interactive maps directly within the website and allows you to conveniently use the map feature.

By visiting the website, Google receives the information that you have accessed the corresponding sub-page of our website. This is done regardless of whether Google provides a user account that you are logged into, or if there is no user account. If you’re logged into Google, your data will be assigned directly to your account. If you do not wish this data to be associated with your Google profile, you must log out before activating the button. Google stores your data as usage profiles and uses them for advertising purposes, market research and/or tailor-made website design. Such an evaluation is carried out in particular (even for users who are not logged in) to provide appropriate advertising and to inform other users of the social network about your activities on our website. You have a right to object to the formation of these user profiles, and you must contact Google to do so.

For more information on the purpose and scope of the data collection and its processing by the plug-in provider, please refer to the provider’s privacy policy. There, you will also find more information about your rights and settings options for the protection of your privacy: www.google.de/intl/de/policies/privacy. Google also processes your personal information in the US and is subject to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework

Embedded YouTube videos

On some of our websites, we embed YouTube videos. The operator of the plug-in is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you play a YouTube clip, it connects to YouTube servers. YouTube will be informed of which pages you visit. If you are logged into your YouTube account, YouTube can assign your browsing behaviour to you personally. This can be prevented by logging out of your YouTube account beforehand.

If a YouTube video is played, the provider uses cookies that collect information about user behaviour.

However, anyone who has disabled the storage of cookies for the Google Ad programme will not receive any such cookies, even when watching YouTube videos. However, YouTube also stores non-personal usage information in other cookies. If you want to prevent this, you must block the storage of cookies in the browser.

Further information on data protection at YouTube can be found in the provider’s privacy policy at: https://www.google.de/intl/de/policies/privacy/

Online presence on Facebook, Instagram and LinkedIn social media

We maintain an online presence on social networks and platforms in order to communicate with customers, prospects and users, and to inform them about our services. When using the respective networks and platforms, the terms and conditions, and the data processing guidelines apply to their respective operators.

Unless otherwise stated in our Privacy Policy, we process users’ data whenever they communicate with us via social networks and platforms, e.g. write posts on our online presence or send us messages.

User rights

As a user, you have the right to receive, on request, free information about which personal data has been stored about you. You also have the right to correct incorrect data and to restrict or delete your personal data. If applicable, you can also claim your right to data portability. If you believe your data has been processed unlawfully, you can file a complaint with the appropriate regulatory agency.

Deletion of data

If your request does not conflict with a legal obligation to store data (e.g. data retention), you are entitled to have your data deleted. If it is no longer necessary for its purpose and there are no legal retention periods, data stored by us will be deleted. If deletion cannot be carried out because the data is required for legal purposes, its data processing will be restricted. In this case, the data will be locked and not processed for other purposes.

Right to object

Users of this website can exercise their right to objection and object to the processing of their personal data at any time.

If you would like to correct, block, delete or receive information about the personal data stored about you, or if you have questions regarding the collection, processing or use of your personal data or if you wish to revoke your consent, please contact the following email address: it[at]kuny.ch
